Refund Policy for Digital Products
1. Applicability

2. Right to refund and withdrawal
2.1. Since the Digital Offerings are provided via download, streaming or otherwise electronically delivered, the standard 14-day right of withdrawal under Section 312g BGB (for distance contracts) is limited. The consumer waives this right once the Digital Offering is fully delivered (download started or full access granted) with their express consent and acknowledgement that they thereby lose the right of withdrawal.
2.2. In the case of defective Digital Offerings (i.e., not in conformity with the contract, not functioning as promised or lacking required updates/security) the consumer has rights under § 327 et seq. 3. Conditions for a refund
3.1. A refund request may be made if:

the Digital Offering is faulty or materially non-conforming; or

the service updates required for the duration of availability are not provided, and the consumer cannot reasonably expect the product to function.
3.2. The refund will be processed in the same payment method as used by the consumer unless otherwise agreed.
3.3. If the consumer has already used the Digital Offering (e.g., accessed or consumed significant part of it) a proportional deduction may be applied for the value already received, in line with German jurisprudence.
3.4. Refund requests must be sent to the contact email info@kulkalabs.cz with your order details, description of the issue, and proof of purchase, within a reasonable time after you become aware of the fault.
4. Exclusions or limitations
4.1. If the consumer has expressly requested immediate access and acknowledged the loss of the right to withdraw (see 2.1), then traditional “change of mind” refunds are not applicable.
4.2. Minor deviations or changes in functionality which do not materially impact the purpose or main features of the Digital Offering may not justify a refund.
4.3. Refunds do not apply when the fault is caused by the consumer’s hardware, software environment, misuse or breach of licence terms.
5. Duration of availability and updates
5.1. The provider undertakes to provide updates (including security updates) for as long as reasonably expected given the nature of the Digital Offering. Failure to do so may be treated as non-conformity.
5.2. If the period during which updates must be provided has ended, the provider will inform consumers of this at the time of purchase.
6. Procedure for refunds
6.1. Upon receipt of a valid refund request, the provider will assess the request and respond within 14 days.
6.2. If approved, the refund will be issued without undue delay, but no later than 14 days after the decision.
6.3. The provider may delay the refund until any downloadable product access is revoked or access credentials are disabled.
7. Miscellaneous
7.1. This refund policy is without prejudice to any statutory rights under German law which cannot be waived or restricted by contract.
7.2. For any disputes arising from or in connection with this policy and related contract, German consumer law (BGB) applicable to consumer contracts shall apply.
7.3. The provider reserves the right to modify this refund policy at any time; changes will take effect from their publication on the website.
